CAT Response 2020 - My CAT Claim is in Litigation – Now What?
When a CAT claim enters the litigation phase, the carrier and the insured need to find a middle-ground. While each claim in litigation is different, the process does have a blueprint, and it helps to understand the common components and various differences.

There are a litany of issues that a CAT litigation claim can present, including coverage, bad faith, subrogation questions, the role of precedents, over/under insurance, application of ‘But For’ and Reservation of Rights, and considerations for restoration.

This sixth and final session in our CAT Response 2020 Town Hall series will conclude our portrayal of a fictitious island by examining how the island’s marina, impacted by a hurricane and caught in claims litigation brought on by the operator against the carrier, was resolved.
